NOTICE IS HEREBY GIVEN that the Town of Cascade Council will hold a Public Hearing on the adoption of the Town of Cascade General Penalty Ordinance. The hearing will be held in Cascade Town Hall, located at 9 Front Street North, Cascade, MT, 59421, on May 14, 2026, at 6:00 p.m. The Ordinance 2026-01 will amend the General Penalty and Execution of a Fine. Ordinance 2026-01 can be viewed online at cascademontana.com. Print copies of the proposed Ordinance may be reviewed at Cascade Town Hall. AN ORDINANCE AMENDING TITLE 1, CHAPTER 8, SECTION 1 AND 2 OF THE CITY CODE, AMENDING THE GENERAL PENALTY AND EXECUTION OF A FINE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CASCADE, MONTANA
That Title 1, Chapter 8, Section 1 of the City Code be amended to read as follows:
1.08.010 General Penalty. Whenever, in any provision of this Code or other ordinance of the Town, any act is prohibited, or is made or declared to be unlawful, a misdemeanor or an offense, or whenever in any such provision or ordinance the doing of any act is required or the failure to do any act is declared unlawful, where no specific penalty is otherwise provided therefor, any person upon conviction for the violation of any such provision of this Code or ordinances punished by a penalty of not more than $300 for each violation or if the infraction is a repeat offense, a penalty not to exceed $500 for each repeat violation or by imprisonment not to exceed six (6) months or by both such fine and imprisonment, for each such offense.
That Title 1, Chapter 8, Section 2 of the City Code be amended to read as follows:
1.08.020 Execution of a Fine.
- If the judgment is for a fine alone, execution may issue thereon as on a judgment in a civil case;
- If the judgment is for a fine and imprisonment until fine be paid, the defendant must be committed to the custody of the proper officer and by him detained until the judgment is complied with. The imprisonment must not exceed one (1) day for every ninety-five dollars ($95.00) of the fine.
- Rates Determined by Council: The rates to be charged for imprisonment shall be established by resolution of the Town Council from time to time after a public hearing with notice thereof given as provided by law.
- All ordinances or parts of ordinances in conflict herewith are hereby repealed.
